Please read these product terms and conditions (the “Product Terms and Conditions”) carefully as they affect your rights and liabilities under the law and set out the terms on which K U R T M U L L E R . C O M (the “Company”) makes the products available to you through this Website.

1. ELECTRONIC CONTRACT FORMATION

1.1 The technical steps required to create the contract between you and us are as follows:

(a) You place your order for products on the Website by pressing the order confirmation button at the end of the checkout process.

(b) We will send you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation and does not constitute an acceptance by the Company of your order.

(c) Upon despatch of your order from our warehouse, we will send you an order confirmation email. Acceptance of the order and the completion of the contract between you and us will take place on the despatch to you of the products ordered, unless we have notified you that we do not accept your order or you have cancelled your order.

1.2 The details of your specific contract will not be filed by the Company.

1.3 The contract will be concluded in English.
2. PRICES

2.1 The prices payable for the products that you order are clearly set out in the Website. If, by mistake, the price which appears on the Website is not the correct price for a particular product, we are not obliged to supply that product to you at the stated price, provided that we notify you before the product is despatched to you.

2.2 All prices stated on the Website are inclusive of United Kingdom VAT.

2.3 Due to circumstances beyond our control, prices may have to be altered, including any variations in the rate of VAT payable. If this occurs, you will be notified and requested to reconfirm your order at the amended price.

3. AVAILABILITY

3.1 The purchase of products displayed on the Website is subject to availability and we shall not be liable to you in the event that we are unable to supply a product to you.
4. PAYMENT

4.1 The total cost of your order is the price of the products ordered plus the applicable delivery charges as set out in the Delivery section of these terms and conditions.

4.2 Payment can be made by any of the following methods:

(c) Visa Delta;
(d) Visa;
(e) JCB;
(f) Maestro;

4.3 Authority for payment must be given at the time that you place your order. You will not be charged for products until they are despatched to you.

4.4 All card payments are processed by Barclays Merchant Bank Services and WorldPay for a commission fee which is included in the cost of your purchase.

5. DELIVERY

5.1 Delivery will be made to the address specified by you at the time of ordering.

5.2 Delivery within the UK Mainland (England, Scotland, Wales and Northern Ireland) will be by Royal Mail or Business Post and will usually be made within 3-5 working days of the date of the order confirmation email. Delivery to other destinations will be by FedEx, TNT, UPS and delivery times will vary - please contact us for details: http://www.kurtmuller.com/t-contact.aspx. We shall not be liable to you for any loss resulting from delay in delivery to you.

5.3 The following delivery charges will apply to orders placed through the Website:

5.4 Orders & Deliveries to the USA are not being processed through this website as USA sales agencies, partnership alliances and brand licence agreements are presently being negotiated.The website is being updated to incorporate a new website link for the USA market. This website will be launching soon.

6. CANCELLATION

6.1 You have the right to cancel your order up to 7 working days after the date of order of the products by contacting our customer service team.

6.2 If a product has already been despatched to you before you notify us that you wish to cancel the order, you must return the product to us in accordance with our Returns procedure.

7. RETURNS / EXCHANGES

7.1 If, for any reason, you need to return or exchange a product to us, you must do so within 14 working days of the date of delivery. Please use the following procedure for returning any product to us:

• Keep the product in the original packaging, unworn and in its original condition;

• Contact our customer service team to obtain a returns authorisation number;

• Indicate on the product returns card (enclosed with your order) the returns authorisation number and the reason for returning or exchanging the product;

• Enclose the original dispatch note relating to your return that accompanied the goods when they were first delivered by our carrier to you.

• Alternatively – if you prefer you can visit one of our KM stores and exchange your item with another product – you will still need to call customer services for an authorisation number and also bring with you a completed product returns card and the original dispatch note.

7.2 Please note the following points in relation to returns.

(a) Products must be returned to us in perfect condition and with any price labels still attached. We reserve the right to withhold refund of the entire purchase price if the product is returned in a condition which makes it unfit for resale;

(b) We shall not be liable for the non-receipt by us of returned goods. Please send returned products to us by registered post and retain a copy of the certificate of posting from the Post Office.

(c) In the interest of Hygiene we cannot exchange or refund underwear or socks.

(d) Upon receipt by us of the returned products, once verified, your credit/debit card will be credited with the purchase price of the products, excluding the return postal charges (unless the goods are faulty or returned due to an error on our part).

(e)ALL sale items are subject to availability & once purchased are NON REFUNDABLE. KM privilege card discount or any other promotional discounts cannot be used against sale items.

8. LEGAL NOTICE

These Product Terms and Conditions incorporate the terms set out in the Legal Notice http://www.kurtmuller.com/t-legalnotice.aspx and acceptance by you of these Product Terms and Conditions shall be deemed to be an acceptance by you of the Legal Notice.

10. GOVERNING LAW AND JURISDICTION

These Product Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Product Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
